General terms of sale described below have for object to govern the set of the contractual relations between CRISTALLERIE DE PARIS whose head office is situated:

For any customer, placing an order on our web-site www.cristallerie-de-paris.fr, will have to accept unconditionally the present general terms of sale. Any order placed is intended for the personal use of the customers. The customers should refrain themselves from any partial or total resale of products. If a condition came to be lacking, it would be considered as being governed by the existing conditions of sale.
1 - Products
The customers are informed on the web-site about the essential characteristics of the products for the table and the interior decoration. It is reminded that photos illustrating the product and its description do not enter the contractual field. So, in case of any error, CRISTALLERIE DE PARIS cannot be held responsible.
No customer complaint will be acceptable in the case of an article being unavailable.
2 - Prices
The prices are indicated in Euros (inclusive of all taxes). CRISTALLERIE DE PARIS reserves the right to modify its prices at any time without prior notice, knowing that articles will be charged according to the price affixed at the time of the order. Total payment should be made when confirming the order. At no time, the paid sums can be considered as deposit or advance payment.
These prices are applicable only within the context of e-selling (remote sale). The affixed prices cannot be negotiated in the shop and vice-versa. The invoice, serving if necessary as guarantee, is sent for every order.
3 - Terms of payment
The products and postage charges must be paid at the time of the order.
You can settle your purchase by bank card, Visa or MasterCard (on-line secure payment), by bank cheque or bank transfer.
For payment made by credit card on our website, all the data are immediately coded in SSL mode. This information can only be processed by BNPPARIBAS computers followed by the highly secured system (3D Secure) of the BNPPARIBAS bank which in turn liase with the bank of the customer. Neither CRISTALLERIE DE PARIS nor any other person on the Web can see your card number. Your bank account will be debited the next day following confirmation. Your order will then be validated after acceptance of the payment.
The payment by bank cheque should be issued on the name of CRISTALLERIE DE PARIS at the following address: CRISTALLERIE DE PARIS 1, rue de PARADIS 75010 – PARIS. The order will be processed only upon reception of your cheque.
4 - Bearing of postal and delivery charges
The countries of delivery are the following ones: Metropolitan France (Corse, overseas French Departments and territories, Europe and foreign countries). Customers should contact us or our services for queries regarding delivery cost.
The shipping cost will be added to your final order. Additional shipping cost may be charged depending upon the particular size or special conditions required for shipping. The customer recognizes to be fully aware that delivery charges are to be added to the cost of the ordered goods.
5 - Confirmation of the order to the customer
CRISTALLERIE DE PARIS will send a confirmation of order to the customer by e-mail after receiving the order.
The order of the customer is considered as accepted following validation by CRISTALLERIE DE PARIS.
6 - Delivery
The deliveries are made either: At the address indicated by the customer (except on Sunday and public holidays). Our carriers (UPS, CHRONOPOST and others) are appointed to deliver the parcel, in your presence.
In the case of an order with several brands of products, it can be made in one step (by grouping the suppliers).
Or: directly in store, where the customer can take possession of the products (forwarding charges will be excluded). A copy of the order form as well as the ID card will be asked as documentary evidences.
7 - Delay in delivery
CRISTALLERIE DE PARIS cannot be questioned and held responsible for unforeseeable circumstances or for any problem related to the transport or manufacture of the product which would tend to delay or prevent the delivery of the ordered products.
The client cannot claim any compensation in case of any delay in delivery. Delivery date given is purely indicative. In case of predictable extension of delivery deadline appearing on the confirmation of order, CRISTALLERIE DE PARIS makes a commitment to inform the customer as soon as possible and by every possible means so that the latter can then choose of the preservation of his/her order.
In case of failure to respect the deadline mentioned upon confirmation of order, the customer can cancel it by the sending a registered letter with recorded delivery at the following address:

The cancellation will be taken into account by CRISTALLERIE DEPARIS only if the shipping or the delivery has not been carried out between the sending and the reception of the registered letter.
Conformity of the goods: Upon reception of the goods, you have to check thoroughly the parcel and verify the contents in the presence of the delivery man before signing the delivery note.
If the delivered products underwent damage during the transport and are damaged (breakage, impact), you should refuse the parcel by writing legibly the motive of your refusal on the delivery note. The parcel will be returned and you will be again delivered free of charge.
If the quantities do not correspond to what is registered on the delivery note, fill the form legibly while entering your reservations in a precise and detailed manner. Write down precisely the quantity and the name of the missing products before signing the slip. Confirm through the contact form, from the contact section, or call us on the phone number available on your order.
Attention: Once you will have signed the delivery note, without precise reserve, the responsibilities of the carrier and CRISTALLERIE DE PARIS will be cleared. The mention "subject to unpacking" is not legal and cannot be held. If the person responsible for delivery does not give you sufficient time to check the goods, you should imperatively note on the slip "Impossible to verify parcel because the driver is in a hurry and refuses to wait". In case of dispute, you will then have 48 hours to declare it by writing to the carrier in a registered letter with an acknowledgement receipt(a copy needs to be sent to us). In case, no remark has been noted on the delivery note, it will be considered that the goods have been duly delivered. Thereafter, any claim or complaint regarding the state of products cannot be received.
8 - Cooling-off period
As per the article L 121-16 of the consumption code, the customer has a cooling-off period of seven days as from the order. However, in case one or more articles are unavailable in store and require to be specially ordered at our manufacturers, no cooling-off period and refund will apply.
If the customer uses(wears out) this right to withdraw and if the delivery has already taken place, the return of products has to be made in their original packing, in perfect condition, accompanied with all the possible accessories and the notes, otherwise thirty percent of your total payment will be retained. Incomplete, damaged, used or soiled articles cannot be taken back.
The customer will have to bear the return cost. CRISTALLERIE DE PARIS will either exchange the goods or refund the sum paid by the customer corresponding with the returned goods, excluding the cost of sending. The refund will be done within a delay of maximum thirty days as from receipt of the returned goods.
The refund will be made either by credit on the bank account of the card used for the payment or by bank cheque drawn up on the customer’s name. For return of the goods, the customer should contact our services beforehand on 01 47 70 20 54 (from Monday to Saturday from 9:30 am till 6:30 pm) or send an email to the following mail address: contact@cristallerie-de-paris.
9 - Retention of ownership
The delivered products remain the property of CRISTALLERIE DE PARIS until complete and final payment has been made by the customer (actual collection of the payment) by CRISTALLERIE DE PARIS.
10 - Completeness
In the event that any clause of the present contract would be null and void by a change in legislation, regulations or by a judicial decision, it does not in any way affect the validity and compliance of these Terms of sale.
11 - Duration
The present conditions apply throughout the duration of the on-line publishing of the services offered by CRISTALLERIE DE PARIS. They can be modified at any time by our company.
12 - Governing law and jurisdiction
The present conditions are subjected to the French law.
The disputes ensuing from the application of the present general terms of sale are subjected to the French law and only the French court can judge it.
The disputes between CRISTALLERIE DE PARIS and any customer will be referred to the commercial court of Paris.
13 - Proof
The final validation of the order will constitute proof of the order in its entirety according to the statutory provisions of March 13th 2000 and will be worth payability of the sums engaged by the selection of articles appearing on the order form.
This validation is worth signature and explicit acceptance of all the processings made on the website. Computerized records, saved in the computer system of the company CRISTALLERIE DE PARIS under reasonable secured conditions, will be considered as proofs of the communications, transaction orders and payments between the parties.
The archiving of the orders and invoices are made on a reliable and long-lasting manner that constitutes a true and durable copy in accordance with article 1348 of the Civil Law.

15 - Declaration to the CNIL
In accordance with the Law N ° 2004-801 of August 6th 2004, amended Law N ° 78-17 of 6th January 1978, on the protection of individuals with regard to the processing of personal data, a declaration was made to the Commission nationale de l'informatique et des libertés on 15th April 2009, concerning the standard NS-48 and declared under the number 135 87 35.
